Whilst every care has been taken by the organising committee and relevant landowners in facilitating these events, the committees and landowners will not be responsible for any injury to any person taking part in any way whatsoever in the event nor liable for any damage resulting from acts or omissions of any participants or spectators.
It is the responsibility of those taking part, or their legal guardians in the case of minors, to ensure that participants have appropriate and adequate insurance cover for personal injury and third-party liability cover and that they take all reasonable steps to ensure their own safe participation in the events. In particular in relation to equestrian events, they are advised to ensure both they and their mounts are both suitable and competent and that riders wear appropriate protective clothing, including headgear.
Please note that the organising committee reserve the right to refuse any person from participating in the event. Whilst the organising committee will do all they can to ensure the safety of all attending, we must point out that individuals have a duty of care to themselves and others. The organising committee are required by law to take appropriate action with regards to incidents of discrimination, harassment or victimisation towards those who participate or spectate in Jethart Callant’s Festival organised events.
Where the organising committee, or persons acting on their behalf, are informed or become aware of such behaviour, the details will be notified to the police and the alleged perpetrators may be subjected to police investigation and prosecution.
The organising committee wish all who participate in any way in this annual historic event to do so in a safe and secure way and we emphasise that there will be zero tolerance of those who wilfully break the law. Every Participant or spectator takes part on the understanding that they accept all the terms and conditions as published in this publication.
All participants, helpers and spectators are reminded that horses and ponies are large, often unpredictable animals. They are beautiful and, at the same time, a potential hazard. A horse’s behaviour should never be taken for granted – even the oldest and quietest horse can behave unpredictably at times. A horse’s natural instinct dictates either “fight or flight” as a defence reaction if feeling threatened.
Should a horse break free from their handler then you should not attempt to stop/catch the horse unless you have considered and accept the risks involved.
Jethart Callant’s Festival and landowners accepts no liability for accident, illness or injury to horses, riders, spectators or any other person or property.
Dogs must be kept on leads at all times.
Please respect farmers and property owners.
Please do not block roadways and field gates
All litter including food should be taken home or deposited in bins or bags that may be provided.
No food should be left where animals might pick up and eat it.
FOR THE ATTENTION OF ALL RIDERS
Horse riding is a dangerous sport. Anyone who follows in the Cavalcade during the Jethart Callant’s Festival puts themselves at risk. The rides to Morebattle,Southdean and Redeswire are all in excess of twenty miles and cover some rough country, therefore they require a high level of fitness from both horse and rider and are not suitable for novices. Horses that are likely to kick must have a red ribbon on their tail. You must also use a green ribbon for youngsters/novice horses and a blue ribbon for stallions. Do not ride faster than a walk within the parking areas. Any horse or rider, who, in the opinion of the marshals or organising committee is not capable of completing any of the rides for any reason will be asked to leave. The Muster Point for all rideouts, unless otherwise specified, will be in the OLD BONGATE. IMPORTANT NOTICE. Please note that NO HORSEBOXES or TRAILERS are allowed to park in the Bus Station at any time throughout the Festival. Marshalls will be in charge Marshals will be appointed for each rideout and will wear armbands for identification. These Marshals are appointed to assist in the smooth running of the Festival and all riders are requested to follow their requests/instructions at all times. Foot marshals will be suitably positioned (as required) at gates and crossings and again all due respect should be given to their instructions. Marshals, both foot and riding, will be issued with radios. Riders Participation It is the responsibility of all riders taking part to maintain good control of their mount throughout the ride. If a rider becomes dismounted at any time, it is their responsibility to either remount and re-join the ride or return their horse to the stable or horse box. It must be noted that while it is the role of foot and mounted marshals to advise and direct riders it is not their duty to control loose horses. Whilst participating in all Jethart Callant’s Festival ridden events, all riders must wear a riding safety hat at all times whilst mounted on the horse, this includes mounting and dismounting. Any rider thought to have consumed too much alcohol may be asked to leave the ride. Hirers, Marshals & Police have the right to stop riders who they believe to be unfit to ride. Routes and Timing The routes are pre-arranged between the Organising Committee, landowners and police. Therefore, all riders are requested to adhere to the agreed route. The Herald is the Official Timekeeper and Pacemaker on the ride-outs and should not be overtaken, unless authorised to do so. The route taken by the Herald is the only one that should be followed. If any rider has to leave the ride and return home it may be quicker to return by road. However, if returning through fields always remember to close gates. Also, any rider leaving the Cavalcade early must notify a marshal and will be responsible for making their own way home. Because of flood damage, work in progress, etc. on the various routes, the Festival Committee reserve the right to alter the route of the Cavalcade on any of the ride-outs during the Festival. Emergency procedure In the event of any problem arising, be it damage to gates or fences, breakage of essential tack or injury to horse or rider, immediate contact should be made with either a riding or foot marshal so the necessary action may be taken (i.e., first aid, veterinary help or help with spare tack). It is the owner’s responsibility for all costs incurred. Dress Code for riding To maintain our high standards, only smart, suitable riding wear will be accepted, (stocks or ties, no sports tops or t-shirts). This also applies to anyone joining the ride at any point. It should be noted that protective headgear must be worn with appropriate dark, self-coloured silks. (No multi coloured silks). Anyone not adhering to the dress code will be asked to leave the ride. Young Riders No person should ride in the Cavalcade who may require to be led, unless they have made arrangements for someone to lead them. It is also important that they are able to keep up with the Cavalcade. An experienced adult should accompany all young riders; all young riders must carry contact details for parent or guardian with them. Insurance It is the responsibility of those taking part, or their legal guardians in the case of minors, to ensure that the participants have appropriate and adequate insurance cover for personal injury and third-party liability cover and they take all reasonable steps to ensure their own safe participation in the events. Riders must have their own public liability insurance.
FOR THE ATTENTION OF ALL BIKERS
When participating in the events. In particular the longer rides, bikers are advised to ensure: 1. Both they and their bikes are competent and suitable and that bikers wear appropriate clothing, including bike helmets. 2. Bikes should be in a good order and a spare tube should be carried. 3. A nominated adult, parent or guardian should accompany all bikers under the age of 16. All young bikers must carry contact details for parent or guardian with them in case they need collected from the route. 5. Bikers will form their own group behind the Marshals car or at least 20m behind the horses. 6. The muster point for all rideouts for the bikers will be at the Tavern. 7. Anyone who follows in the cavalcade during the Jethart Callant’s Festival puts themselves at risk. If any biker has to leave the ride and return home, it may be quicker to return by road. Bikers leaving the rides will be responsible for making their own way home. Ensuring that all gates are closed. All bikers must follow the Scottish Outdoor Access Code at all times remembering the hazards horse riders so extra care should be taken to avoid crossing there path and the importance of ensuring gates are shut. Experienced bikers will be nominated on each ride to ensure gates are closed. SCOTTISH OUTDOOR ACCESS CODE • Ride responsibly, close all gates and be courteous to all other land users. Help us portray a good image for Mountain Biking • Respect all farmland and animals. There will be livestock around so slow down when necessary to avoid frightening them • Leave no litter • Take extra care on road sections • HAVE FUN!!
